Terms and Conditions of Sale (CGV)
1. Scope and Acceptance
These Terms and Conditions of Sale ("T&C") govern all sales made through the website operated by avenzioco (the "Seller"). By placing an order on this website, the customer ("Customer") agrees to be bound by these T&C without reservation.
These T&C apply to all products sold via the online store and prevail over any other document unless otherwise agreed in writing.
2. Products and Prices
Product descriptions and prices are indicated on the website. Prices are displayed in the selected currency and include applicable taxes unless otherwise stated. Shipping costs, if applicable, are specified before the order is confirmed.
The Seller reserves the right to modify prices at any time. However, products will be invoiced based on the price in effect at the time of order confirmation.
In case of a manifest pricing error, the Seller reserves the right to cancel the order and refund any amounts paid.
3. Orders
Orders are placed online through the website. An order is considered final once payment has been successfully completed and a confirmation email has been sent to the Customer.
The Seller reserves the right to refuse or cancel any order in case of suspected fraud, unauthorized payment, dispute, or abnormal order activity.
The Customer is responsible for providing accurate and complete information when placing an order.
4. Payment
Payments are processed securely via Stripe and other available payment methods displayed at checkout. By submitting payment information, the Customer authorizes the Seller and its payment processor to charge the provided payment method for the total order amount.
The Seller does not store full payment card details. All payment transactions are encrypted and processed in compliance with applicable security standards (including PCI-DSS).
If a payment is declined or reversed, the order may be suspended or canceled. In case of suspected fraudulent transactions or chargebacks, the Seller reserves the right to provide relevant information to Stripe and competent authorities.
5. Delivery
Products are delivered to the address provided by the Customer at the time of order. Delivery times are estimates and may vary depending on the destination and carrier.
The Seller shall not be held liable for delays caused by carriers, customs, or force majeure events.
The risk of loss or damage passes to the Customer upon delivery.
6. Right of Withdrawal
In accordance with applicable consumer protection laws, Customers may have the right to withdraw from their purchase within fourteen (14) days from receipt of the product, without giving any reason.
To exercise the right of withdrawal, the Customer must notify the Seller in writing within the withdrawal period.
Returned products must be unused, in their original condition and packaging. Return shipping costs are borne by the Customer unless otherwise required by law.
Refunds will be processed within fourteen (14) days after receipt and inspection of the returned goods, using the same payment method as the original transaction, unless otherwise agreed.
The right of withdrawal does not apply to customized, perishable, or digital goods once delivered or accessed, where legally permitted.
7. Guarantees
Products benefit from applicable legal guarantees, including the legal guarantee of conformity and the guarantee against hidden defects, where applicable under local law.
If a product is defective or non-conforming, the Customer must contact the Seller with proof of purchase and supporting evidence (e.g., photos).
The Seller may offer repair, replacement, or refund in accordance with applicable laws.
8. Complaints and Customer Service
Any complaint or request for information should be addressed to the Seller via the contact details provided on the website.
The Customer agrees to attempt to resolve any dispute amicably before initiating legal proceedings.
In case of unresolved disputes related to payments processed via Stripe, the Seller reserves the right to submit relevant documentation in response to chargebacks or payment disputes.
9. Liability
The Seller shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the products purchased.
Nothing in these T&C excludes or limits liability where such limitation is not permitted by law.
10. Applicable Law and Jurisdiction
These T&C are governed by the laws applicable in the Seller’s country of establishment, without regard to conflict of law principles.
Any dispute arising out of or in connection with these T&C shall be subject to the exclusive jurisdiction of the competent courts of the Seller’s place of establishment, unless mandatory consumer protection rules provide otherwise.
11. Amendments
The Seller reserves the right to modify these T&C at any time. The applicable version is the one in force at the time the Customer places the order.
